¿LÍMITES? ¿QUÉ LÍMITES? TRES DESAFÍOS CONTEMPORÁNEOS SOBRE LA PROPIEDAD INTELECTUAL

El artículo analiza críticamente las tensiones conceptuales y políticas de la propiedad intelectual (PI) ante las transformaciones tecnológicas. Sostiene que la PI es una construcción jurídico-política ambigua que desborda la lógica de la propiedad privada al aplicarse a bienes intangibles. Se examinan tres ejes: la consideración de la PI como categoría propietaria, la inadecuación de los marcos clásicos frente a bienes digitales reproducibles y los límites de la apropiabilidad en entornos de libre circulación. Se concluye que la PI expresa una crisis del canon propietario liberal y abre paso a modelos colaborativos de producción y transacción de conocimiento.
