Abstract

The article critically analyzes the conceptual and political tensions of intellectual property (IP) in the face of technological transformations. It argues that IP is an ambiguous legal-political construct that transcends the logic of private property when applied to intangible goods. Three axes are examined: the consideration of IP as a proprietary category, the inadequacy of classical frameworks regarding reproducible digital goods, and the limits of appropriability in contexts of free circulation. It concludes that IP reflects a crisis of the liberal proprietary canon and opens the way to collaborative models of knowledge production and exchange.
