DAMAGES TO VICTIMS OF CRIMES OF GENDER VIOLENCE IN THE SPANISH LEGAL SYSTEM

Abstract

The puporse of the work is to compensate for moral damage in crimes of gender violence in the Spanish system. Moral damage, in general, is a complex figure due to impossibility of establishing a specific definition of it and its inherent characteristics. In criminal proceedings for gender violence, it takes on a special relevance due to the particular circumstances that usually occur in this type of crime. That is way, in the present study, the general notes that characterize moral damage are examined and this figure is delimited from other types of damage, to then analyze the problems that arise in gender violence procedures both for their accreditation and for their appreciation, concluding with a final assessment.
