INTERVENCIONES CONDUCTUALES EN SALUD PÚBLICA: MARCO REGULATORIO DE SUFICIENCIA Y EQUIDAD PARA EL DERECHO CHILENO

Resumen

La creciente utilización de intervenciones conductuales en políticas sanitarias, especialmente en sistemas marcados por desigualdades estructurales, ha reabierto el debate sobre los límites normativos del poder persuasivo del Estado. El objetivo del artículo es analizar los criterios normativos y jurídicos que determinan la legitimidad del uso de técnicas de nudging en políticas sanitarias, evaluando su compatibilidad con el estándar de suficiencia sanitaria, la equidad distributiva y la autonomía frente a la manipulación conductual. Los resultados muestran que la legitimidad del nudging exige su anclaje en el umbral de funcionamiento normal y en la protección del rango de oportunidades, así como su sometimiento a estándares jurídicos de necesidad instrumental, proporcionalidad, transparencia, equidad y control jurisdiccional, estableciendo además la prioridad del boosting como expresión de mínima intrusión. Se concluye que el nudging solo es justificable cuando opera como mecanismo de habilitación de la agencia dentro de un marco regulatorio robusto que prevenga la manipulación y la profundización de desigualdades sanitarias.
